The "Loss of a Chance" Doctrine
Generally speaking, cancer patients who are diagnosed at an early stage of the disease have a much better long-term prognosis. Treatment of the disease at an early stage is often less invasive and not as harsh.
Today, 25 states, the District of Columbia and the U.S. territory of Puerto Rico have adopted the "loss of a chance" doctrine. Under this legal concept, a breast cancer or colorectal cancer patient who would have had a five-year prognosis of 95 percent survival can recover compensation for that "increased chance of death" or the harsher treatment regimens they have had to endure as a result of the delayed diagnosis of their cancer.
